Who you are buying from

You are buying from Nick Howarth, trading in his own name. Township Tales is the name this site publishes under; it is not a separate legal entity.

Nick Howarth is a sole proprietor. There is no company registration number, because there is no registered company.

He is not registered for VAT. No VAT is charged on any order, the prices shown are the whole amount payable, and no tax invoice showing VAT can be issued.

Placing an order

Choosing an edition, a quantity and a delivery country and pressing Pay with PayFast creates an order and sends you to PayFast to pay. The order is not a completed sale until PayFast confirms the payment to us; until then it sits unpaid and nothing is dispatched.

The price charged is the one this server calculated and recorded when the order was created. It is not read from anything sent by your browser, and it is not recalculated later — a price change tomorrow does not affect an order placed today.

We may refuse or cancel an order and refund it in full — for example where an edition is out of stock, where a delivery address cannot be posted to, or where a price was published in obvious error.

Payment

Payment is taken in South African rand by PayFast. Card details are entered on PayFast’s pages and never reach this site or this server.

Outside South Africa you are quoted a published price in your own currency. Because PayFast settles in rand, the amount charged is that price converted at the exchange rate at the moment the order is created. Both figures are shown on the order form before you pay, and the rand one is the amount charged. The rate moves, so the rand figure can change between reading the page and paying; your bank converts back at its own rate and may add a fee of its own.

Delivery, refunds and returns

Set out in full on the policies page, which forms part of these terms. In short: copies are printed close to the reader and posted from there, postage is quoted per country and shown before you pay, dispatch is within a few working days of payment, delivery windows are estimates, and a damaged or incorrect book should be reported within seven days.

War in Peace, its cover, and the text and photographs on this site are the copyright of Nick Howarth. Buying a copy buys you that copy. It does not transfer any right to reproduce, distribute, broadcast, adapt or transmit the work, in whole or in part, without written permission.

Using the site

You agree not to:

• interfere with the site or the server it runs on, or try to reach parts of it you have not been given access to;
• submit an order you do not intend to pay for, or use payment details that are not yours;
• use the contact form to send unsolicited commercial messages;
• copy the content of the site for republication.

The order and contact endpoints are rate limited. Automated or repeated requests may be refused.

What we do not promise

The site is provided as it is. We do not promise it will be available without interruption — it is one server, and servers are restarted and occasionally fail.

Nothing in these terms limits your rights under the Consumer Protection Act or any other law that cannot be contracted out of. Where a term here conflicts with such a right, the right wins.

Accuracy

War in Peace is a personal memoir. It sets out one person’s recollection of events he lived through. It is published as that, and not as an official or historical record.

Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.

Changes

These terms may change. The version that applies to your order is the one published when the order was placed; the date at the top of this page says when it last changed.
